Terms and conditions
1. Introduction
1.1.The aim of Click Relationships is to provide a digital service for individuals and couples over the age of 16 to access information that enables them to work on and strengthen their relationship. The purpose of Click Relationships is to provide information and resources only. Click Relationships does not intend to provide any other service for which it may be held liable. Please note, this is a “self-help” resource; the service does not provide online counselling, or give direct legal advice, neither is it a place for crisis relationship support or active intervention.
1.2. When you register with us you are stating that you are over 16 years of age. You agree that any information you provide to us about yourself upon registration or at any other time will be true, accurate and complete.
1.3. By accessing any of the pages or using any of the services or functionality provided on Click, you agree to comply with the Terms & Conditions set out below. These Terms and Conditions apply to all users, but in some cases they will only apply to registered users.
1.4. Also, please read our Data Protection & Privacy Policy Statement, which forms part of these Terms and Conditions.
1.5. If you do not agree with any of these Terms & Conditions then please do not make any use of Click Relationships and leave it immediately.
1.6. Click Relationships is operated by and a service of OnePlusOne; the operating name of OnePlusOne Marriage and Partnership Research. OnePlusOne is a Registered Charity No. 1087994 and a private company Limited by Guarantee, registered in England and Wales, company No. 4133340 whose registered address is: OnePlusOne, Central Working Shoreditch, 6-8 Bonhill Street, London, EC2A 4BX
1.7. References to “we”, “us” and “our” throughout this document should be read as references to OnePlusOne.
References to “Click”, “Click Relationships”, and “the site” throughout this document should be read as reference to the entire Click service related to the root domain of www.clickrelationships.org. Subdomains on this root domain will be subject to their own terms and conditions.
References to “editorial” content throughout this document should be read as content written by employees of OnePlusOne only. References to “member-published” or “user-published” content throughout this document should be read as referring to content that has been published by the community, and not by OnePlusOne staff.
1.8. When you register on Click and you select “I have read and understood the terms and conditions”, this means you have complied with terms and conditions (which includes the data protection and privacy policy) as a registered user.
1.9. When you register on Click and you select “Tick to receive our email newsletter, and receive very occasional emails for research purposes“, you agree to receive Newsletters from us by email, and also occasional emails relating to the collection of research data. To make sure we are continually offering a useful service we will regularly carry out evaluation with a sample of users registered on the site. Occasionally we may contact you by email to ask if you would be willing to participate in any such evaluation, however you are under no obligation to do so. If you do not wish to receive future emails, you may unsubscribe from the mailing by following the instructions given at the bottom of any such email.
1.9. We have taken care to ensure Click Relationships is as technically robust as possible. However, as certain technical matters may be beyond our control, we cannot guarantee that you will have uninterrupted access to Click Relationships at all times.
2. Use of content
2.1. All copyright and all other intellectual property rights (including, but not limited to, copyright) in all text, videos, photographs, illustrations, audio, interactives, software, service marks, logos and other materials on the pages of Click Relationships (“the content”) are owned by OnePlusOne, or are reproduced on Click Relationships with permission of the relevant rights owner.
2.2. The content may not be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form nor by any means without OnePlusOne’s express prior written consent, except as stated at clauses 2.3 and 2.4 below.
2.3. You may read, view, print, download and (where appropriate) listen to the content of an individual page for private and personal non-commercial use only provided that all copyright, trade mark and other proprietary notices contained in the original content on any copy of such content is retained. You may make more copies electronically or otherwise of any of the content for your personal use, but you may not re-copy or further distribute, sell, publish or transmit any part of the content by electronic or any other means.
2.4. If you are a professional who works with families as part of your job then you may access, view and print content from Click and freely distribute to your clients providing you acknowledge copyright of the material and its source. You must not charge for any content from Click Relationships that you distribute.
2.5. You agree not to sell, resell, supply or otherwise make Click Relationships content or extracts or other information derived there from available in any manner or on any media whatsoever to any third party without the express prior written consent of OnePlusOne.
2.6. The names, images and logos identifying OnePlusOne, its projects, products and services (including, but not limited to, the name and logo of “Click” or “Click Relationships”) , or those of third parties, are the proprietary marks of OnePlusOne, and/or may be the proprietary marks of third parties. Any use made of these marks may be an infringement of rights in those marks and OnePlusOne reserves all rights to enforce such rights that it might have.
3. Prohibited use
3.1.You agree not to use Click Relationships, including commenting on content, to:
3.1.1. post, upload, e-mail or otherwise transmit any material, the publication, dissemination, use or possession of which infringes the rights of any person or which is unlawful in any other respect;
3.1.2. contribute or use in any manner which could damage, disable, overburden, or impair the service;
3.1.3. make available personal identifiable data about any person other than yourself, or to collect or store personal data about other users;
3.1.4. obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through Click Relationships;
3.1.5. impersonate any other person or entity (including, but not limited to, a member of OnePlusOne or anyone authorized to act on their behalf), or to provide false or inaccurate information;
3.1.6. act, communicate or make a contribution to Click Relationships in any way which is threatening, harmful, abusive, distasteful, vulgar, racist, sexist, ageist or otherwise discriminatory, defamatory, sexually offensive, hateful, invasive of another’s privacy or obscene, or which will (or potentially will) harass, distress, embarrass or inconvenience or be objectionable to any person or which might restrict or inhibit the use and enjoyment of the Click by any person;
3.1.7. post, upload, e-mail or otherwise transmit any unsolicited or unauthorised advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation or commercial exploitation;
3.1.8. post, upload, e-mail or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, restrict, steal, destroy, limit the functionality of or compromise the integrity of any computer software or hardware or telecommunications equipment;
3.1.9. disrupt the normal flow of dialogue, or otherwise act in a manner that negatively affects other users’ ability to engage in effective usage of Click Relationships;
3.1.10. create a database (electronic or otherwise) that includes any content, including, but not limited to user generated content held on Click Relationships;
3.1.11. use Click Relationships in any way whatsoever to solicit information from other users for any media or marketing activities, or;
3.1.12. contribute to Click Relationships in any way which may bring OnePlusOne into disrepute.
4. Listening room usage
4.1. You acknowledge that the listening room feature provided through Click Relationships by OnePlusOne is not a place to seek or receive counselling, crisis support or intervention.
4.2. You acknowledge that transcripts of conversations with a Listener are saved. This enables OnePlusOne to review them for learning purposes and assess the quality of the assistance provided.
4.3. Transcripts will never be shared with a third party without explicit consent.
4.4. OnePlusOne may reference any information shared in the transcripts that have legal implications, see 4.1 and 4.2 of the Data Protection and Privacy Policy.
5. Use of member-published content
5.1. You acknowledge that you are entirely responsible for all material that you upload or post on Click Relationships, and any consequences that arise from it.
5.2. You must not enter any personal identifiable information on Click Relationships including, but not limited to, surnames, address details, dates of birth, telephone/mobile numbers and email addresses. Any posts and/or comments including such information entered on Click Relationships will be subject to editing and removal.
5.3. Furthermore, you acknowledge and accept that at our sole discretion, we have the right to close or suspend a user’s access to Click Relationships without question or obligation to enter into further discussion on the matter.
5.4. You must enter all posts and comments in English. Any posts and/or comments not written in English will be subject to editing and removal.
5.5. You acknowledge that OnePlusOne does not pre-screen, edit or monitor the content entered by users as either blogs or questions, but that we (and those authorised by us) have the right (but not the obligation), in our sole discretion and without prior warning or notice, to refuse or remove any material that is published.
5.6. You must not promote or advertise commercial companies, products or services on the user submitted articles and questions; neither must you send chain, junk, spam or any bulk mail of any kind.
5.7. Journalists, reporters or anyone involved working in the media must not use member submitted articles and questions to gain access to individuals for information of any kind.
5.8. If you are concerned about material posted on Click Relationships, or become aware that any material or any activities carried out that are offensive, unlawful, or contrary to these Terms & Conditions or infringe any third party rights in any way, please contact us at the email provided on the “Contact us” page which you can find as a link on the footer of each Click Relationships webpage.
5.9. Any emails received will be processed by us within 72 hours of receiving such notification. We will remove any such material or we will use reasonable endeavours to otherwise deal with the concern, however we see fit in our sole discretion. OnePlusOne will not be held liable for any harm, offence or emotional distress caused during this time.
5.10. You acknowledge and agree that we are not obliged to enter into any discussion following the removal of any material from user-published content, or any other action we may take under or with reference to these Terms & Conditions.
5.11. You acknowledge and understand that any views expressed in Click Relationships are the views of the Click Relationships community and do not necessarily reflect the views of, and are not endorsed, by OnePlusOne. These views cannot therefore be attributed to OnePlusOne.
5.12. Without limiting the foregoing, OnePlusOne and its designees shall have the right to remove any material from member-published articles, member-published questions and member-published comments that is contrary to these Terms & Conditions or is otherwise objectionable, whether by reference to these Terms & Conditions, the house rules or otherwise.
5.13. You further acknowledge that the Click website (and all content published on it by OnePlusOne or registered members) is not a place to seek or receive counselling, crisis support or intervention.
5.14. By submitting content to Click (including, but not limited to, user-submitted articles and questions) you are granting OnePlusOne a non-exclusive irrevocable royalty-free license to reproduce, modify, translate, make available, distribute and sub-license that content in whole or in part and in any form (now known or later developed) anywhere in the world subject to our Data Protection & Privacy Policy.
5.15. By submitting any messages, suggestions or material to Click, you waive all of the moral rights that you may have under Chapter IV of the Copyright, Design and Patents Act 1988 in respect of any such message, suggestion or material.
5.16. You acknowledge that OnePlusOne may establish general practices and limits concerning the use of Click, including (but not limited to) the maximum number of days that material on the site will be retained by OnePlusOne. You agree that we have no liability for the deletion or failure to store any messages, suggestions, material or other communications maintained on or transmitted to Click Relationships, including, but not limited to, member-published articles and questions, and any content stored in your personal profile.
5.17. If you do not wish to grant OnePlusOne the rights set out above, do not submit contributions to Click Relationships.
6. Warranties and liability
6.1.Your use of Click Relationships is at your sole risk. The content has been included in good faith, is only for your general information, and is for non-commercial use. In particular, the content does not constitute any form of advice, recommendation or arrangement by OnePlusOne and is not intended to be relied upon by users in making (or refraining from making) any specific decisions or to be a substitute for obtaining professional advice. YOU ARE RESPONSIBLE FOR CHECKING THE ACCURACY OF RELEVANT FACTS AND OPINIONS GIVEN ON THE SITE BEFORE ENTERING INTO ANY COMMITMENT OR TAKING ANY OTHER FORM OF ACTION OR INACTION BASED UPON THEM. ONEPLUSONE DOES NOT REPRESENT OR GUARANTEE THE TRUTHFULNESS, ACCURACY OR RELIABILITY OF POSTINGS SUBMITTED BY USERS ON THE SITE, OR ENDORSE ANY OPINIONS EXPRESSED BY USERS. ONEPLUSONE WILL NOT BE HELD LIABLE FOR ANY OFFENCE, HARM, EMOTIONAL DISTRESS OR LOSS THAT OCCURS AS A RESULT OF THE USE OR VIEWING OF THIS WEBSITE. All conditions, warranties, terms and undertakings express or implied statutory or otherwise in respect of the provision of the content and the site are excluded to the fullest extent permitted by law.
6.2. We will take every effort to ensure that the content on the site is accurate, however we cannot be held liable for any inaccuracies or typographical errors identified. Also, while we will ensure best practice is followed for ensuring the technical integrity of the site, we cannot warrant its availability or that it will be free of viruses or other harmful components.
6.3. Click Relationships contains links to other websites (“third party sites”). We neither endorse nor take responsibility for the availability or content of third party sites and will not be a party to, or in any way responsible for, any transaction concerning goods or services available from such third party sites. If you decide to use these links to access third party sites you do so entirely at your own risk.
6.4. Save as expressly provided for in these Terms & Conditions, we shall not be liable in any jurisdiction for any direct, indirect or consequential loss or damage (including, without limit, loss of property or profit, business revenue or opportunity or anticipated savings and loss of or damage to any data) or for any costs, claims or demands of any nature whatsoever arising directly or indirectly out of the use of or access to the site, content or any part there of or in respect of any defect therein or any failure to provide or the late delivery of the same howsoever arising.
6.5. You agree to indemnify and hold OnePlusOne and its officers, employees and agents harmless from any claim or demand made by any third party due to or arising from your use of the site (including, but not limited, your use of the member-publishing facilities).
7. Breach of the terms & conditions
7.1. We will be entitled to restrict, suspend or terminate your membership or deny you access to the site or take such other action as we deem appropriate if we determine, in our sole discretion, that you are in breach any of the Terms and Conditions or that your use of the site is inappropriate or otherwise unacceptable.
7.2. The restriction, suspension or termination of our service pursuant to this section will be without prejudice to any rights that we may have against you in respect of your breach of these Terms and Conditions.
8. Changes to these terms & conditions, and amendments to the Click service.
8.1 We reserve the right, at our discretion, to make changes to any part of Click, including, but not limited to editorial content and member-published content, for whatever reason we deem necessary and at our sole discretion.
8.2 Due to our policy of updating and improving Click Relationships, we may wish to change these Terms & Conditions from time to time and you agree to be bound by the Terms & Conditions, which apply at the time of your use of the service. Any significant changes made to either the Terms and Conditions or privacy and data protection policy – we will notify all members via email.
9. Governing Law and Jurisdiction
9.1. These Terms & Conditions shall be governed by, and construed in accordance with, English law and you and OnePlusOne irrevocably agree that the courts of England shall have exclusive jurisdiction to settle any dispute, which may arise out of, under, or in connection with the same or the legal relationship established by them.
9.2. Any advice or guidance given on the site cannot be deemed valid outside of England. Users accessing Click Relationships from outside of England should take legal and professional advice in the jurisdiction in which they reside.
10. General
10.1. If any provision of these terms is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms & Conditions, which shall remain in full force and effect.
10.2. Failure by either party to exercise any right or remedy under these terms does not constitute a waiver of that right or remedy. Headings in these terms are for convenience only and will have no legal meaning or effect.
